These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Subscriber," or "you") and PokeCardRadar LLC, a Florida limited liability company ("PokeCardRadar LLC," "we," "us," or "our"), governing your access to and use of the TCG Vault platform available at pokecardtracker.com and any associated applications, APIs, or services (collectively, the "Service").
By creating an account, clicking "I Agree," accessing the Service, or otherwise using TCG Vault in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are entering into these Terms on behalf of a business entity, you represent and warrant that you have full legal authority to bind that entity to these Terms, and references to "you" include that entity.
If you do not agree to these Terms, you must immediately stop using the Service and close your account.
These Terms are entered into pursuant to and are governed by the Florida Electronic Transactions Act, §§ 668.001–668.006, Florida Statutes, which recognizes electronic agreements as legally valid and enforceable. Your electronic acceptance carries the same legal weight as a handwritten signature.

TCG Vault is a cloud-based, multi-tenant inventory and sales management platform designed specifically for Pokémon Trading Card Game (TCG) vendors who sell at card shows, trade events, local game stores, and similar venues.
TCG Vault is part of the PokeCardRadar platform ecosystem (pokecardradar.com). The parent platform offers related services including consumer-facing card alert tools. Your TCG Vault account is governed separately by these Terms unless a unified account arrangement is explicitly disclosed to you.
The Service is intended for business and semi-professional use by card show vendors and collectors managing inventory at scale. It is not a consumer product and is not designed for use as a financial investment platform or as a source of certified appraisals.
You must be at least 13 years of age to use TCG Vault. We do not knowingly collect personal information from children under 13. If you are between 13 and 17, you must have parental or legal guardian consent to use the Service. If we learn that a user under 13 has provided personal information, we will promptly delete that information. Parents or guardians who believe a minor under 13 has registered an account should contact us immediately at .
To use TCG Vault, you must:
The Service is designed for vendors, sellers, and collectors operating in the Pokémon TCG secondary market — including card show participants, online sellers, and hobby shop operators. Commercial, business, and professional use is expressly permitted and encouraged. Personal hobbyist use is also welcome, subject to these Terms.
You represent and warrant that your use of the Service will comply with all applicable federal, state, and local laws, including any laws governing the sale, trade, and commerce of collectible trading card game products.
To access the Service, you must register for an account by providing a valid email address, a password, and such other information as we may request from time to time. You agree to provide accurate, current, and complete information during registration and to keep that information updated.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
We will not be liable for any loss or damage arising from unauthorized use of your account credentials, provided that such unauthorized access did not result from our own security failures. You acknowledge that we cannot and do not guarantee the security of information you transmit over the internet.
Each account is for use by a single business entity or individual. You may not create multiple accounts to circumvent usage limits, subscription fees, or account terminations. Team members must be added through the designated multi-user functionality described in Section 12.
We reserve the right to suspend or terminate your account, with or without notice, for violations of these Terms, failure to pay applicable fees, fraudulent activity, or conduct that we reasonably believe poses a legal or reputational risk to PokeCardRadar LLC or other users. Where practicable, we will provide notice and an opportunity to cure before termination for non-payment or first-time policy violations.
TCG Vault is currently in an Early Access (Beta) phase. Access is limited to an invited group of vendors. The Service is provided during this period on an experimental, "as-available" basis. Features, functionality, pricing, and terms are subject to change without notice.
When TCG Vault transitions from Early Access to general availability, we will provide at least 30 days' advance notice to existing users. At that time, paid subscription plans will be introduced (see Section 6). Early Access users will be given the opportunity to review updated terms and pricing before any charges are initiated.
During the Early Access phase, access to TCG Vault may be provided at no charge, at a special promotional rate, or under terms communicated to you at the time of your invitation. The specific terms applicable to your current Early Access enrollment are those communicated to you directly and supplement these Terms.
Upon general availability, TCG Vault will offer paid subscription plans. Current anticipated pricing begins at $24.99 per month, subject to change. Final pricing tiers, features, and billing cycles will be announced at least 30 days before any paid subscription commences for existing Early Access users.
Different subscription tiers may provide different levels of functionality, team member seats, API call limits, AI feature usage, and data storage. We reserve the right to adjust plan features, pricing, and availability at any time, subject to the notice requirements in Section 21 for material changes and the specific billing notice requirements in Section 7 for recurring charges.
All fees are stated in U.S. dollars. You are responsible for any applicable sales tax, use tax, VAT, or similar taxes imposed by your jurisdiction on your subscription. Where required by law, we may collect and remit applicable taxes.
TCG Vault subscriptions are recurring and will automatically renew at the end of each billing period (monthly or annual) at the then-current subscription rate unless you cancel before the renewal date.
By subscribing to a paid plan, you expressly authorize PokeCardRadar LLC to charge your payment method on a recurring basis, without further action on your part, until you cancel. Your subscription will continue and your payment method will be charged automatically each billing cycle.
To avoid being charged for the next billing period, you must cancel at least 24 hours before your renewal date. Cancellation instructions are in Section 7.3 below.
When you subscribe to a paid plan, you must provide a valid payment method (credit card, debit card, or other approved payment instrument). You represent that you are authorized to use the payment method provided. You authorize us to charge all fees and applicable taxes to your payment method on the billing schedule associated with your plan.
If your payment method fails or is declined, we may attempt to reprocess the charge. If payment remains outstanding after a reasonable grace period (typically 7 days), we reserve the right to suspend or downgrade your account until payment is received.
Subscriptions are billed in advance for the upcoming billing period (monthly or annual, as selected). Mid-cycle upgrades to a higher-tier plan may be prorated. Downgrades take effect at the start of the next billing period.
You may cancel your subscription at any time by:
Cancellation takes effect at the end of your current paid billing period. You will retain access to the Service through the end of your paid period. We do not issue prorated refunds for the unused portion of a billing period unless required by applicable law or at our sole discretion in exceptional circumstances.
After cancellation, you have 10 days to export your User Data before your account and data are scheduled for deletion (see Section 8). We will send you a reminder email when your account enters the deletion queue.
All subscription fees are non-refundable except as required by applicable law or as expressly stated in a separate promotional offer. If you believe you were charged in error, contact us within 30 days of the charge at and we will review your request.
We will provide at least 30 days' advance written notice (via email to your registered address) before any increase in your subscription price takes effect. If you do not cancel your subscription before the price increase takes effect, you will be deemed to have accepted the new pricing. This practice complies with the FTC's Negative Option Rule (16 C.F.R. Part 425), as amended effective January 2025.
If we offer a free trial for any paid plan, we will clearly disclose the trial duration and what happens at the end of the trial period (including the plan and price that will begin) before you enroll. To avoid being charged at the end of a free trial, you must cancel before the trial period ends.
You own your User Data. Period. PokeCardRadar LLC claims no ownership over the inventory records, sales logs, trade records, pricing notes, or any other data you create or upload through TCG Vault. We will never sell, license, monetize, or transfer your User Data to any third party for their independent use.
We hold only a limited, non-exclusive license to process and store your User Data solely as necessary to provide the Service to you. This license terminates when your account is closed and your data is deleted.
By using TCG Vault, you grant PokeCardRadar LLC a limited, non-exclusive, revocable, worldwide license to access, process, store, transmit, and display your User Data solely for the following purposes:
PokeCardRadar LLC does not and will not sell, rent, barter, license, or otherwise transfer your User Data (including aggregated data attributable to your account) to third parties for advertising, marketing, data brokerage, competitive intelligence, or any other purpose not listed in Section 8.1. This commitment applies regardless of any change in our business model, ownership, or financial condition, except as described in Section 8.6 (Business Transfer).
You have the right to export all of your User Data at any time using the built-in export function in your account dashboard. Exports are available in CSV and JSON formats. We will process export requests within a reasonable time, typically within 24–48 hours for standard exports.
Upon account cancellation, you may request a full data export and we will make your data available for download for 10 calendar days following your cancellation date. After that period, your data will be scheduled for deletion per Section 8.4.
Following account cancellation or termination:
We may retain certain data for longer periods where required by law (e.g., billing records, fraud investigation records) or where you have outstanding disputes. De-identified, aggregated analytics derived from your data are not subject to deletion.

In the event of a merger, acquisition, sale of assets, or other business transfer involving PokeCardRadar LLC, your User Data may be transferred to the successor entity. The successor entity will be required to honor these Terms with respect to User Data, or provide you the opportunity to delete your account before any material change in data handling practices.
PokeCardRadar LLC implements commercially reasonable administrative, technical, and physical safeguards designed to protect your User Data from unauthorized access, disclosure, alteration, and destruction. These measures include:
However, no system is completely secure. We cannot guarantee that your data will be immune from all unauthorized access, and we are not responsible for unauthorized access resulting from your own security failures (e.g., compromised credentials, insecure devices).

Market pricing data displayed in TCG Vault is sourced from third-party platforms (including TCGPlayer and eBay) and is provided for informational and reference purposes only. Prices shown do not constitute certified appraisals, financial advice, or guarantees of market value. Actual transaction prices may differ materially from displayed estimates.
Pricing information is retrieved from third-party market data APIs and marketplaces, including but not limited to TCGPlayer and eBay. This data reflects recent historical sales or current listing prices on those platforms and may:
When you request pricing data through TCG Vault, only card names, set identifiers, and condition descriptors are transmitted to third-party pricing APIs. We do not transmit your personal information, account details, business identity, or inventory quantities to these external services.
Nothing in the Service — including market pricing data, price trend charts, deal evaluation outputs, or AI-generated suggestions — constitutes financial, investment, or tax advice. You are solely responsible for all buy, sell, and trade decisions you make, and we strongly encourage you to conduct your own independent research before completing any transaction. PokeCardRadar LLC expressly disclaims all liability for losses incurred in reliance on pricing data or suggestions provided through the Service.
Use of pricing data sourced from TCGPlayer or eBay through the Service is also subject to those platforms' respective terms of service and data use policies. We are not affiliated with, endorsed by, or in a sponsorship relationship with TCGPlayer, eBay, or their parent companies.
AI-powered features in TCG Vault — including deal evaluation, pricing suggestions, and trade analysis — are powered by third-party AI models (Google Gemini and/or Anthropic Claude) and are provided for informational purposes only. AI output may be inaccurate, incomplete, or misleading. PokeCardRadar LLC is not responsible for any trade decisions, purchases, sales, or financial outcomes resulting from your reliance on AI-generated content.
AI-generated deal evaluations and suggestions are produced by large language models that:
Your use of AI features does not create any fiduciary, advisory, or professional relationship between you and PokeCardRadar LLC or any AI model provider. We are a software tool provider, not a trading advisor or appraiser.
All trade, sale, and purchase decisions are yours alone. AI output is a starting point for your own research, not a substitute for it. Before completing any significant transaction, you should independently verify pricing through multiple sources, evaluate the physical condition of cards, and exercise your own business judgment.
AI features are powered by Google (Gemini models) and/or Anthropic (Claude models). When you use AI features, relevant query data (such as card names, trade parameters, and pricing context) may be transmitted to these providers' APIs. We do not transmit personal identifiers to AI providers. Your use of AI features is subject to both these Terms and the applicable terms of service of the AI provider. See also Section 17 (Third-Party Integrations).
AI features are subject to availability and rate limits imposed by third-party AI providers. We do not guarantee the continuous availability of AI features. AI features may be modified, limited, or discontinued at any time with reasonable notice.
Each TCG Vault account is controlled by an Account Owner, who is responsible for managing access for all Team Members invited to the account. The Account Owner is solely responsible for all actions taken by Team Members under the account, including but not limited to data entry errors, accidental deletions, unauthorized exports, or violations of these Terms.
Account Owners may configure permission levels for Team Members (e.g., read-only, data entry, full access) through the platform's team management settings. Account Owners should grant only the level of access necessary for each Team Member's role.
All Team Members must independently meet the eligibility requirements in Section 3, including the minimum age of 13. By inviting a Team Member, the Account Owner represents that the Team Member meets all eligibility requirements.
Account Owners may remove Team Members at any time through the account settings. Upon removal, the Team Member's access to the account is immediately revoked. Account Owners are responsible for revoking Team Member access promptly when Team Members leave the organization or when their role no longer requires access.
The Service is licensed for use by the subscribing business entity and its direct Team Members. You may not resell, sublicense, or otherwise provide Service access to third parties outside your own business organization without our express written consent.
You agree not to use TCG Vault for any of the following purposes:
Engaging in prohibited uses may result in immediate account termination, forfeiture of prepaid subscription fees, referral to law enforcement authorities, and civil liability. We reserve the right to cooperate fully with law enforcement investigations relating to use of the Service.
As stated in Section 8, you retain full ownership of all User Data you create, upload, or input through the Service. Your inventory records, sales data, trade logs, notes, and other business data are yours.
TCG Vault — including its underlying software, source code, algorithms, databases, user interface designs, visual assets, logos (excluding the Pokémon trademarks and third-party marks), documentation, and the "TCG Vault" and "PokeCardRadar" brand names — is the exclusive intellectual property of PokeCardRadar LLC and is protected by applicable copyright, trademark, trade secret, and other intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. This license does not grant you any right to copy, modify, distribute, sell, sublicense, publicly display, or create derivative works based on the Service or its components.
Any feedback, suggestions, ideas, or feature requests you voluntarily share with us regarding the Service become our property and may be used by us without restriction, attribution, or compensation to you.
"TCG Vault," "PokeCardRadar," and related logos are trademarks or service marks of PokeCardRadar LLC. You may not use these marks without our prior written consent. All other trademarks appearing in the Service belong to their respective owners. See Section 15 for the Pokémon trademark disclaimer.
TCG Vault and PokeCardRadar are not affiliated with, endorsed by, sponsored by, or approved by The Pokémon Company International, Inc., Nintendo Co., Ltd., Game Freak, Inc., or Creatures Inc. (collectively, "Pokémon Owners").
"Pokémon," "Pokémon TCG," Pokémon character names, card set names, card artwork, and all associated trademarks and copyrights are the exclusive intellectual property of the Pokémon Owners. All rights are reserved by the Pokémon Owners.
TCG Vault is an independent, third-party software tool for secondary market vendors. Any reference to Pokémon card names, set names, or game content within the Service is solely for the purpose of identification and inventory management of lawfully obtained physical collectibles, and is made under principles of nominative fair use.
Any card artwork, imagery, or official Pokémon content that may appear in the Service as part of pricing lookups or reference data is obtained from third-party sources and remains the property of the Pokémon Owners. We do not claim any rights to such content.
Our collection, use, and handling of personal information is governed by our Privacy Policy, available at pokecardradar.com/privacy and at pokecardtracker.com/privacy, which is incorporated into these Terms by reference.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POKECARDRADAR LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING:
Some jurisdictions do not allow the exclusion of certain warranties. To the extent that applicable law does not permit such exclusions, those exclusions apply to the maximum extent permitted.
This Service is not designed for, and should not be relied upon for, mission-critical business operations without appropriate backup and redundancy measures maintained on your end.
IN NO EVENT WILL POKECARDRADAR LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL SUBSCRIPTION FEES YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) $50.00 USD.
During the Early Access / Beta period when no fees are charged, our maximum aggregate liability to you is $50.00 USD.

The limitations of liability set forth in this Section 19 reflect a reasonable allocation of risk between you and PokeCardRadar LLC and form an essential basis of the bargain between us. These limitations apply notwithstanding any failure of essential purpose of any limited remedy. Without these limitations, we would not be able to offer the Service at the current pricing.
Some states do not allow the exclusion or limitation of certain categories of damages. In those states, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits our liability for (a) death or personal injury caused by our gross negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be limited or excluded under applicable law, including the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), §§ 501.201–501.213, Florida Statutes.
You agree to indemnify, defend, and hold harmless PokeCardRadar LLC, its members, officers, directors, employees, contractors, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

For non-material changes (such as corrections to typographical errors, clarifications that do not alter your rights, or updates to contact information), we may update the Terms without advance notice, and your continued use of the Service after the update constitutes acceptance.
For material changes, if you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the effective date of the changes. If you continue to use the Service after the effective date, you will be deemed to have accepted the modified Terms.
We will maintain an accessible record of material Terms changes with their effective dates. The "Last Updated" date at the top of this page reflects the most recent revision.
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of laws provisions.
Before initiating any formal dispute proceeding, you agree to contact us at with a written description of your dispute and proposed resolution. We will make a good-faith effort to resolve the dispute informally within 30 days of receiving your notice. This informal dispute resolution is a condition precedent to initiating arbitration.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO A JURY TRIAL.
Except as provided in Sections 22.4 and 22.5, any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including questions about the formation, validity, enforceability, or scope of this arbitration agreement — shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules or Commercial Arbitration Rules (as applicable), which are available at www.adr.org.
Arbitration shall be conducted in Hillsborough County, Florida, or by remote means if both parties agree. The arbitrator shall apply Florida law. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND POKECARDRADAR LLC EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS — WHETHER IN ARBITRATION OR IN COURT — WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If, for any reason, a claim proceeds in court rather than arbitration, you and PokeCardRadar LLC each waive any right to a jury trial and any right to participate in a class action lawsuit, class-wide arbitration, private attorney general action, or any other representative proceeding.
Notwithstanding the arbitration agreement, either party may bring an individual action in small claims court in Hillsborough County, Florida (or such other small claims court of competent jurisdiction), provided the matter remains within the jurisdictional limits of that court. Either party may also seek emergency injunctive or equitable relief from any court of competent jurisdiction to prevent irreparable harm pending arbitration.
For any matters that are not subject to arbitration under these Terms, you and PokeCardRadar LLC each consent to the exclusive personal jurisdiction of, and venue in, the state and federal courts located in Hillsborough County, Florida. You waive any objection to venue in those courts.
Any claim or cause of action arising out of these Terms or the Service must be filed within one (1) year after such claim or cause of action arose. Claims filed after this period are forever barred, regardless of any statute of limitations to the contrary.
Nothing in these Terms limits any rights you may have under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), §§ 501.201–501.213, Florida Statutes. We are committed to honest, transparent business practices. If you believe we have engaged in deceptive or unfair conduct, please contact us at before initiating any legal proceeding.
